Privacy Policy

This Privacy Policy describes the collection, use, disclosure, retention, and protection of personal data by bry3d llc ("BRY3D"). It applies to the BRY3D website, platform, 3D viewers, and related services. This Policy also describes applicable privacy rights and the procedures for exercising those rights.

When a BRY3D business customer collects personal data through its use of the Services, including through a configurator, inquiry form, chat assistant, or customer portal, that customer ordinarily acts as controller and BRY3D acts as processor. Requests concerning that data should be directed to the applicable customer. BRY3D processes such data pursuant to the customer's instructions and the Data Processing Agreement.

4. AI features

The Services include optional artificial-intelligence features, including chat-assistant functionality and response suggestions. When enabled, relevant message content and configured product information are transmitted to the artificial-intelligence service provider selected for the account for the purpose of generating an output. BRY3D does not use personal data submitted through the Services to train general-purpose artificial-intelligence models. These features are not intended to make decisions producing legal or similarly significant effects within the meaning of Article 22 GDPR. Customers remain responsible for reviewing outputs and for all quotes, agreements, and other actions taken in reliance on those outputs.

5. Recipients and service providers

BRY3D discloses personal data to service providers and other recipients only as necessary to operate, secure, support, and administer the Services:

The current list is maintained in the Data Processing Agreement. BRY3D does not sell personal data or disclose personal data for cross-context behavioral advertising.

BRY3D may also disclose personal data to comply with applicable law, legal process, or governmental request; to protect the rights, property, or security of BRY3D, its customers, or others; or in connection with a merger, financing, acquisition, reorganization, bankruptcy, or sale of assets.

6. Google API data

If you connect Google Calendar or Google Drive, we access that data solely to provide the scheduling and file features you requested, and delete cached data when you disconnect the integration or delete your account. BRY3D's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. You can revoke our access at any time in your Google account permissions.

7. International transfers

BRY3D is established in the United States, and personal data may be processed in the United States and other jurisdictions in which BRY3D or its service providers operate. Where the GDPR or UK GDPR applies to a restricted transfer, BRY3D relies on an applicable adequacy decision, the European Commission's Standard Contractual Clauses, the UK International Data Transfer Addendum or Agreement, or another legally recognized transfer mechanism, as applicable.

You have the right to access, rectify, and erase your personal data; to restrict or object to processing; to receive your data in a portable format; and to withdraw consent at any time (without affecting processing before withdrawal). To exercise these rights, email admin@bry3d.com. We respond within one month.

You may lodge a complaint with the supervisory authority in the jurisdiction of your habitual residence, place of work, or place of the alleged infringement. A list of European Economic Area supervisory authorities is available through the European Data Protection Board.

10. Your US privacy rights

Subject to applicable law and any statutory thresholds or exceptions, residents of certain United States jurisdictions may have rights to confirm processing; access, correct, or delete personal information; obtain a portable copy; and appeal a denied request. Applicable law may also provide rights to opt out of sale, targeted advertising, or certain profiling. BRY3D does not sell personal information or share personal information for cross-context behavioral advertising.

During the preceding 12 months, BRY3D may have collected the categories described in Section 2, including identifiers, professional or employment-related information, commercial information, internet or other electronic network activity, and customer records. BRY3D may disclose these categories to the service-provider categories identified in Section 5 for the business purposes stated in Section 3. BRY3D does not use or disclose sensitive personal information for purposes requiring a right to limit under the CCPA.

Requests may be submitted to admin@bry3d.com. BRY3D may require information reasonably necessary to verify the request and may deny or limit a request as permitted by law. An authorized agent may submit a request on a resident's behalf, subject to verification of the agent's authority. BRY3D will not unlawfully discriminate against an individual for exercising an applicable privacy right.

11. Children

The Services are intended for business use and are not directed to children under 16. BRY3D does not knowingly collect personal data directly from children under 16. BRY3D will take appropriate steps to delete such data upon obtaining actual knowledge of its collection, subject to applicable law.

12. Security

BRY3D maintains administrative, technical, and organizational safeguards designed to protect personal data against unauthorized access, acquisition, alteration, disclosure, or destruction. These safeguards include encryption in transit, access controls, and backup procedures. No security measure provides absolute protection. Additional information appears in the Security Statement. BRY3D will provide notifications of a personal data breach when and as required by applicable law.

13. Cookies

The marketing pages do not use analytics or advertising cookies. Neither demonstration page sets cookies; the fence demo instead loads mapping and address-search resources from third parties, as set out in the Cookie Policy. The authenticated BRY3D platform uses cookies and similar technologies necessary for authentication and session security and may use product analytics as described in the same policy.

14. Changes to this policy

BRY3D may amend this Policy from time to time. The revised Policy will be posted at this location with a revised "Last updated" date. Where required by law, BRY3D will provide additional notice of material changes.
